Payment and Cancellation Policy

Payment Policy
​
At The Invicta Method, all prices for services, including private training sessions, workshops, classes, and courses, are discussed and agreed upon at our discretion.
For one-off private training sessions, the price will be mutually agreed, and an invoice will be issued for your review. Payment for these sessions is due 24 hours prior to the scheduled session.
For ongoing private training sessions, the fee per session will be established in advance, and payment is due 24 hours before each session. If you wish to pay in cash, please arrange this directly with Dimple Gorsia prior to the session.
For services, classes, workshops, and courses listed on our website, where fees are specified, payments should be made either through the website or via an invoice sent directly by Dimple Gorsia.
Full payment is required before the session, course, or event commences, and relevant details will be specified in relation to each service or course.

Cancellation Policy

We understand that unexpected circumstances may arise, and we have a no-refund policy in place. However, we recognize that, in certain exceptional cases, a refund may be granted out of empathy and at the discretion of Dimple Gorsia T/A The Invicta Method. These cases will be reviewed on an individual basis and must be discussed directly with Dimple Gorsia.
To respect our time and that of other clients, we have a 24-hour cancellation policy. If you need to cancel or reschedule your session, you must provide at least 24 hours' notice. In such cases, we will either reschedule the session or, in exceptional cases, process a refund as described above.
If a session is cancelled or rescheduled with less than 24 hours' notice, the full session fee will be forfeited, and no refund or rescheduling will be offered.
We appreciate your understanding and cooperation, as it helps us maintain a smooth and efficient service for all clients.

Health and Safety

The Invicta Method, including its instructors, employees, and affiliates, is committed to ensuring the health and safety of all participants during training sessions. We take reasonable and proactive steps to create a safe environment for all involved, including implementing safety protocols, conducting regular risk assessments, and providing appropriate guidance during each activity. We have established comprehensive measures to mitigate risks, including the use of proper equipment, appropriate training techniques, and ensuring instructors are well-qualified to supervise any physical training, self-defence activities, and associated exercises (“Activities”).

However, while The Invicta Method and Dimple Gorsia make every effort to protect participants from harm, it is essential to acknowledge that participation in physical activity and self-defence training carries inherent risks. As such, all participants are expected to act responsibly and take appropriate precautions to protect their own health and safety, as well as the safety of others. This includes following the instructions provided by the instructors, using equipment safely, being aware of their surroundings, and immediately reporting any injury, discomfort, or concerns during the training. Participants are also expected to respect the safety of fellow participants and instructors, understanding that all parties involved share the responsibility for maintaining a safe environment.

Participation in services offered by The Invicta Method, including self-defense training and physical activities, involves inherent risks, such as the potential for physical injury or property damage. While we take every reasonable precaution to ensure a safe environment and prioritize your well-being, accidents may still occur. By engaging in these activities, participants acknowledge and accept this possibility.
We strongly recommend consulting a healthcare professional before beginning any physical training program, particularly if you have pre-existing medical conditions or concerns.
The Invicta Method and its representatives cannot be held responsible for injuries, damages, or outcomes resulting from participation, except where required by law. Liability Waiver and Release

By accessing and/or participating in any services provided by Dimple Gorsia, trading as The Invicta Method (“The Invicta Method”), including but not limited to self-defence training and physical activity, you acknowledge and agree to the following terms and conditions:
1. Acknowledgment of Inherent Risks
You, the undersigned participant, acknowledge that participation in physical training, self-defence activities, and associated exercises (“Activities”) provided by The Invicta Method involves inherent physical risks. These risks may include, but are not limited to, physical injury, disability, or even death, as well as damage to personal property. Participation may also involve physical exertion, contact with other participants, and use of various training equipment, all of which may increase the risk of injury. You expressly acknowledge these risks and voluntarily assume full responsibility for any injury, loss, or damage resulting from your participation in the Activities.

2. Assumption of Risk
By engaging in the Activities, you voluntarily accept all risks, whether known or unknown, arising out of or related to your participation. You acknowledge that the risks involved in the Activities may arise from the actions, inactions, or negligence of yourself or others, including instructors, participants, or third parties. You hereby assume full responsibility for any and all risks, injuries, or damages that may occur as a result of your participation, including, but not limited to, risks associated with the physical demands of the Activities and the use of training equipment.
3. Waiver, Release, and Discharge of Liability
To the fullest extent permitted by law, you hereby irrevocably and unconditionally waive, release, and discharge Dimple Gorsia, trading as The Invicta Method, its instructors, agents, employees, contractors, affiliates, and any other parties involved in providing the Activities (“Released Parties”), from any and all claims, demands, actions, causes of action, suits, damages, losses, or liabilities of any kind, whether personal or property, arising out of or in connection with your participation in the Activities. This includes, but is not limited to, any claims arising from negligence, gross negligence, or misconduct of the Released Parties.
4. Medical Clearance and Health Representation
By participating in the Activities, you affirm that you are physically capable and do not suffer from any medical condition, illness, or injury that would prevent you from engaging in such physical activities. You represent that you have consulted with a qualified healthcare provider and obtained their approval to engage in such physical activities. If you have any concerns or medical conditions, you acknowledge and agree that it is your sole responsibility to seek professional medical advice and clearance prior to participating. You understand that participation in these Activities is voluntary, and you are free to withdraw at any time if you feel unwell or unable to continue.
5. Indemnification and Hold Harmless Agreement
You agree to indemnify, defend, and hold harmless The Invicta Method and the Released Parties from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from or in any way connected with your participation in the Activities, including any claim made by third parties. You further agree to reimburse the Released Parties for any costs, losses, or expenses they incur as a result of any legal action brought against them due to your participation.
6. Governing Law and Dispute Resolution
This waiver and the Terms and Conditions governing your participation in the Activities shall be governed by, and construed in accordance with, the laws of the United Kingdom, without regard to its conflict of laws principles. Any disputes, claims, or actions arising from or related to this waiver or your participation in the Activities shall be resolved exclusively in the competent courts of the United Kingdom.
7. Severability
If any provision of this Liability Waiver and Release is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
8. Acknowledgment of Terms
By continuing to use or engage in the services of The Invicta Method, you affirm that you have read, understood, and voluntarily agree to be bound by these Terms and Conditions, including this Liability Waiver and Release.
